Terms and conditions of Evimeria IMMO FlexCo for the rental of rooms in shared flats via WirMachenWG
§ 1 Scope
These General Terms and Conditions (T&C) apply to all tenancies between Evimeria IMMO FlexCo, Birkenweg 9, 3550 Langenlois, Austria (hereinafter the "Landlord") and tenants of rooms in shared flats arranged via the WirMachenWG platform (www.wirmachenwg.at).
The Landlord does not accept any deviating terms of the tenant unless expressly agreed in writing.
§ 2 Subject of the Contract
The Landlord rents out fully furnished rooms in shared flats in Vienna with access to common areas. The all-inclusive rent typically covers furnishings, electricity, heating, hot water, internet and administration.
§ 3 Conclusion of Contract & Enquiries
Room listings on the website do not constitute binding offers but are invitations to submit enquiries. A tenancy only comes into existence upon signing of an individual rental contract. The Landlord may reject enquiries without giving reasons.
§ 4 Rent & Payment
The monthly rent is payable in advance by the 5th of each month to the account specified in the rental contract. In the event of late payment, statutory default interest (4% p.a.) applies; reminder fees may be charged additionally.
§ 5 Deposit
The deposit serves to secure any claims of the Landlord arising from the tenancy. It is due before moving in and is refunded within four weeks of proper return of the room, less any justified deductions.
§ 6 Term & Termination
Tenancies begin and end as set out in the rental contract. Ordinary termination is possible subject to the agreed notice periods (in writing; email is sufficient). Both parties reserve the right to extraordinary termination for good cause.
§ 7 Use & House Rules
The tenant must treat the room and common areas with care and comply with the house rules. Key rules include:
- The room may only be used for residential purposes
- Subletting is prohibited without written consent
- Smoking is prohibited in the rented premises
- Pets require prior written approval
- Quiet hours: 10 pm to 7 am must be observed
- Common areas must be left clean
Serious or repeated violations entitle the Landlord to extraordinary termination.
§ 8 Maintenance & Defects
The Landlord is responsible for maintenance. Defects must be reported immediately by email to anfrage@wirmachenwg.at . The tenant is liable for damage caused by improper use.
§ 9 Liability
The Landlord is only liable for damage in cases of intent and gross negligence. Liability for slight negligence is excluded (to the extent permitted by law), except for personal injury. The Landlord accepts no liability for lost or damaged personal belongings in common areas. Household insurance is recommended.
§ 10 Data Protection
Personal data is processed in accordance with our Privacy Policy, the GDPR and the Austrian Data Protection Act (DSG).
§ 11 Final Provisions
Austrian law applies. The place of jurisdiction is the court with subject-matter jurisdiction at the Landlord's registered office. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected; invalid provisions are replaced by provisions with a similar meaning (severability clause). Amendments must be made in writing.
